2. Where This Policy Applies

This Policy applies to all services provided under the NOT MY EX brand. That includes our mobile application, website, in-person or online events, and any other platforms, features, or services we operate. By using any of these, you agree to the terms described in this Privacy Policy.

3. Data We Collect

We collect different types of information so we can provide, improve, and secure our services for you:

  • Data you provide: When you create or update your account, you may share basic account details such as your phone number, email, and date of birth. In building your profile, you can provide information like your name, gender, age, characteristics (appearance, personality, lifestyle), sexual orientation, dating preferences, profile photos, approximate location, and, in alignment with this dating concept, also characteristics of your past partner (ex). If you upload content (photos, videos, audio, text, or other media), for example via messaging with other users, that is also part of the data we collect. Purchase data is collected when you make a payment (e.g., subscription details, purchase amount, transaction date), which may include financial information depending on your payment method. When you reach out to customer support, we process any information you choose to share. In certain cases, where allowed by law, we may also receive information about bad actors from third parties to help keep our community safe.
  • Data with your permission: If you grant permission, we may collect precise geolocation data (latitude and longitude) from your device. If you decline, location-based features may be limited.
  • Data generated or collected automatically: Using our service generates usage data such as when you log in, which features you interact with, searches, communications, and interactions with ads. We also collect technical information from your device, including IP address, device type, operating system, app settings, advertising IDs, crash reports, and other identifiers. We collect and process this information primarily to provide and improve our services, personalize your experience, connect you with compatible members, and ensure safety and security on our platform.

4. Data We Share

We only share your information in specific circumstances:

  • With other users: Profile details, photos, and content you share are visible to other users to fascilitate dating and chat features. The data you share with regards to your "ex" partner (in alignment with the dating concept of the service we provide), will not be shared with other users. If you or another user submit a report, we may disclose relevant information about the outcome of that report.
  • With service providers and partners: We work with trusted vendors who support us with hosting, analytics, customer service, marketing, advertising, payments, legal services, and security operations. The information shared depends on the service provided and may include account, profile, content, purchase, usage, technical, or location data.
  • With advertising partners: We may share limited information (such as email addresses, advertising IDs, or technical data) with advertising partners to deliver relevant ads, measure performance, or create audiences similar to yours. These identifiers are not used to personally identify you.
  • With law enforcement: We may disclose information to comply with legal requirements, assist in crime prevention, protect someone’s safety, or defend our legal rights. This may involve any of the data categories described above.
  • In corporate transactions: If NOT MY EX undergoes a merger, acquisition, restructuring, sale, or other organizational change, your data may be transferred as part of that process.

5. Data Retention

We keep your personal data only as long as it is needed for legitimate business purposes and as allowed by law. If you close your account, your profile will no longer be visible to others, and we will delete your data following a safety retention window of three months (or up to one year if your account was banned). This retention period allows us to investigate harmful or unlawful activity.

Certain types of data must be kept for longer: transaction records for up to 10 years (for tax and accounting), credit card information for as long as disputes may be raised, and log data for one year (to comply with data retention laws). Customer support records may be kept for up to six years, and certain other limited data (such as subscription history or location of purchase) may be stored for several years where we have a legitimate interest.

Finally, we may retain non-identifiable data (data that cannot be linked back to you) indefinitely to help us improve our services and develop new features.

6. Your Rights

We want you to feel in control of your information. Depending on where you live, you may have certain rights over your data, which could include the right to access, correct, delete, restrict, or object to how we process your information. You may also have the right to withdraw consent where our processing is based on it, or to request a copy of your data in a portable format.
